DA: Officers not liable in August shooting death

DA: Officers not liable in August shooting death

The Dane County district attorney has deemed the three officers to be not criminally liable after being involved in a deadly shooting in August.

Madison police officers Alex Bol, Adrian Alan and Ed Marshall have been cleared in the shooting death of Charles G. Carll at his home on the 5200 block of Hammersley Road on Aug. 17.

According to a release from the district attorney, the officers were compelled to use deadly force, after Carll ignored commands and came toward officers with a knife.

Officers had been called to Carll's home after reports of a domestic dispute. When they arrived, Carll's wife told officers he was depressed and had cut himself in the stomach with a knife.

Officers located Carll and ordered him to drop his knife, but he started toward officers who first shot a Taser which did not work. According to the release, officers were forced to legally shoot Carll as a response to "genuine fear of deadly force." 

Carll had been living at his home with his partner for nearly 15 years.

Officers Bol and Alan started with MPD in 2008. Marshall started in 2004. MPD Public Information Officer Joel DeSpain said all three will be able to work with supervisors to come back to work after the findings of a department internal investigation are released.
