Activists argue that 13- and 14-year-olds are emotionally and neurologically different from adults and that it amounts to cruel and unusual punishment not to give them a chance at eventual parole. Their opponents argue that serious crimes deserve serious punishments.

FOND DU LAC, Wis. -

An attorney for the Fond du Lac man accused of killing his wife said the woman's death was accidental.

Jason Anderson, 36, is being tried in Fond du Lac County on charges of intentionally shooting his 33-year-old wife, Nicole, in the head in November 2011.

Defense attorney Robin Shellow said Jason Anderson heard a noise in their home the night his wife was killed and fired his gun through the wall of their bedroom. Shellow said the first shot caused Anderson to accidentally fire a second shot, which is the one that killed Nicole.

The Fond du Lac Reporter said District Attorney Dan Kaminsky questioned why Anderson didn't call for help after his wife was shot. Anderson was arrested at a motel in Birmingham, Ala., two days later.
