Madison man cleared in rape case to get compensation

MADISON, Wis. -

A man whose conviction for a 1991 rape was overturned will get $25,000 for the eight years he spent in prison.

Joseph Frey, 54, was being held in the Winnebago County Jail since his conviction was overturned in May 2013.

The compensation ruling comes from the Wisconsin Claims Board. The $25,000 payment is the largest allowed.

Frey was released from jail in July after prosecutors asked the judge to dismiss the case, saying there was insufficient evidence to retry him.

Frey had been convicted of breaking into a UW-Oshkosh student's apartment in 1991 and sexually assaulting her at knife point.

The Innocence Project eventually took up his case, and got DNA found at the crime scene retested. The DNA was determined to match another man who has since died.
