DOJ: Lawsuit judgment against Kenosha company received

KENOSHA, Wis. -

The Wisconsin Department of Justice has obtained a judgment in an environmental lawsuit against Sani Enterprises, according to a release.

The State of Wisconsin brought the case against Sani Enterprises for violations of state environmental laws regulating the maintenance of underground tanks for storage, handling or use of flammable or combustible liquids and the proper abandonment of unused tanks, according to the release.

The tanks are on property known as the “Highway 50 Citgo” at 5616 75th St. in Kenosha, according to the release.

Officials said the laws are designed to protect the waters of the state from harm due to contamination from such liquids.

The lawsuit was brought against Sani Enterprises because it did not bring its storage tanks into compliance until after the Department of Safety and Professional Services referred the violations to the Department of Justice, according to the release.

Sani Enterprises then cooperated with the DOJ and brought the tanks into compliance, according to the release. Sani Enterprises agreed to pay forfeitures, costs and surcharges totaling $5,000.

It is important to have tanks in compliance with the code because soil contaminated with petroleum products contaminates groundwater flowing through it and can emit petroleum vapors that seep into nearby basements, the DSPS said in the release.
