6 hurt in hospital scuffle with patient

MADISON, Wis. -

Six people -- including Meriter Hospital employees and a Madison police officer -- suffered minor injuries Tuesday afternoon as they tried to detain a patient.

Jason Bender, 33, was arrested and faces charges in the incident including battery and disorderly conduct while armed, Madison Police Lt. Cory Nelson said.

Bender was at Meriter earlier Tuesday and left, according to hospital spokeswoman Mary Reinke. When Bender left, police were called due to an unspecified policy.

"According to our safety standards, it was a situation where we needed to call someone to make sure he was returned and police were en route," Reinke said.

The scuffle happened when the patient returned minutes later, Reinke said.

According to the report, Bender had gone to his car parked nearby and drank alcohol, then returned to the hospital carrying a three-foot metal pole.

"[Bender] then began striking counters with the pole and creating a disturbance," Nelson said. Meriter security responded and Bender struck two of them with the metal pole, Nelson added.

Police said during the incident, Bender bit a security guard, which broke the skin, and bit an officer, not breaking the skin.

The report said after Bender was handcuffed he continued to fight and kicked a nurse in the stomach.

Bender was taken to Dane County Jail.

The six injured -- two hospital security guards, two nurses, a social worker and a police officer -- were treated and released.

The hospital policy that caused staff to contact police was not specified because it may compromise protected medical information about the patient, Reinke said.
